On August 25, 2021, Shub Law filed a class action lawsuit against Frito-Lay North America, Inc., for deceptive, unfair, and false advertising practices regarding its “Hint of Lime” tortilla chips. The case was filed in the Central District of California, on behalf of a nationwide class. The case is styled as Ortega v. Frito-Lay North America, Inc., No. 2:21-cv-06849.
DECEPTIVE ADVERTISING
Increasingly, companies are emphasizing their additions of actual fruit ingredients in food products to drive up sales. Frito-Lay boasts on the packaging of its “Hint of Lime” chips that they contain authentic lime in their ingredients. In actuality, the chips do not contain any lime at all. This deceptive practice takes advantage of consumers trying to make healthier choices, and customers may purchase products based on such misrepresentations, paying a premium for deceptively labeled items over comparable products that were not promoted with such inaccuracies.
