Colorado Judge Grants Preliminary Approval of Settlement in Salud Family Health Class Action

Salud Family Health Inc., a Colorado-based healthcare provider, experienced a cyber security incident that compromised Salud’s network on or around September 5, 2023.

The incident resulted in sensitive and confidential patient and employee information such as names, Social Security number, driver’s license number or state identification card number, financial account information, credit card number, passport number, medical treatment and diagnosis information, health insurance information, biometric data, username and password, and other possible personal identifiers being exposed by an unauthorized agent. The data breach affected approximately 427,546 individuals, potentially putting them at risk of fraud or suspicious activity.
Shub & Johns filed a class action lawsuit against Salud in February 2023 in the United States Court for the District of Colorado. On July 28, 2023, Shub & Johns filed a Consolidated Amended Complaint in the 19th District Court for the State of Colorado in Weld County, joining forces and consolidating cases with Mason Law Group LLC.
Preliminary Approval of the Salud Family Health Settlement
After arms-length negotiations with Defendant’s Counsel, Parties in the Salud Family Health Data Breach Litigation agreed to settle the matter. The Court found that the settlement was fair, reasonable, and adequate, and designated Benjamin F. Johns, along with co-counsel, as Settlement Class Counsel. The Court has scheduled a Final Approval Hearing concerning the Salud Data Breach matter for December 13, 2023.
