A Philadelphia Court recently granted a final approval of a $1.83 million settlement in a class action lawsuit against Chestnut Hill Hospital, LLC, Tower Health Medical Group, and other defendants for alleged employment discrimination during the application process, violating Philadelphia’s “Ban the Box” law. The settlement is the first class action settlement under the Philadelphia law, and one of only a handful of class action settlements under a “Ban the Box” law in the United States.
The settlement is now closed. Class Members who submitted valid claims in the settlement can anticipate benefits to be distributed following the Court’s Appeal Period. Jonathan Shub served as a Lead Counsel for the Class.
Chestnut Hill Hospital, now known as Temple Health, along with Tower Health Medical, were accused of violating “Ban the Box” laws that are meant to prohibit employers from asking a job applicant’s criminal history during the application process. Individuals who applied for employment at Chestnut Hill Hospital in Philadelphia between October 1, 2017 and September 30, 2020 and were asked about their criminal history during the application process may have had their rights violated.
Shub Johns & Holbrook, alongside co-counsel, filed a class action lawsuit alleging fair chance hiring law violations in August 2022. In September 2024, the Court granted preliminary approval of Plaintiff’s Class Action and the Parties proposed settlement agreement between impacted individuals and Chestnut Hill and the Tower Defendants.
Consumers were given the opportunity to file a claim pursuant to the settlement agreement through February 3, 2025. On February 25, 2025 the Court held a hearing to determine the overall fairness of the settlement agreement and claim rate.
On April 7, 2025, the Court granted final approval of the class settlement – you can review the final approval order here. Pending any appeals to the case, class members who have submitted valid claims can anticipate benefits later this year.
