A California court recently granted preliminary approval in a lawsuit against AMN Healthcare (“AMN”), wherein plaintiffs allege that AMN violated the California Consumer Privacy Act (“CIPA”) by monitoring and/or recording language interpretation sessions without warning patients that such oversight would occur. The Court preliminarily approved the $4.5 million settlement. All individuals who used AMN’s interpretation services between December 4, 2022 and August 7, 2026 are eligible to file a claim. This case is captioned Carrero, et al. v. AMN Healthcare, Inc. et al., Case No. 37-2023-00052448-CU-NP-CTL. It was filed in San Diego County Superior Court.
Preliminary Approval of the AMN Settlement
In December of 2023, the plaintiffs filed a class action lawsuit against AMN in California state court on behalf of patients who were physically in California when they allegedly participated in a covertly monitored or recorded AMN interpretation session.
Following an earlier mediation session in August of 2025, both parties participated in a final mediation session in January of 2026 where they reached the settlement agreement referenced here. The plaintiffs promptly filed a motion for preliminary approval of the $4.5 million settlement.
The California court then held a preliminary approval hearing of the proposed settlement on July 31, 2026, and subsequently ordered that the settlement was preliminarily approved. That order also stated that Samantha E. Holbrook and Benjamin F. Johns of Shub Johns & Holbrook be appointed class counsel for the settlement class. You can review the court’s order here.
The court has scheduled a final fairness hearing for December 18, 2026 at 1:30 p.m.
