AI Screenings during Employers’ Hiring Process

Two women interviewers discussing in front of another woman interviewee.Shub & Johns LLC launches investigation into different employers that use artificial intelligence screening software during the company’s hiring process after some consumers reported that they lost employment opportunities as a result of the AI software’s biased and discriminatory review tools, and that they were not given the opportunity to opt out of the screening.

Some companies like Workday and CVS have already been involved in litigation after some candidates discovered the employer used artificial intelligence during their interviews without any notice to the consumers. Some consumers found out that the AI software technology provided reports to employers o on the candidates’ “employability scores” which were reportedly based on the candidate’s facial expressions, analysis of their responsibility, and even their sense of honor.

Consumers may have found the bases for which AI concluded its employability scores to be potentially biased or discriminatory. The American Civil Liberties Union (ACLU) have requested the Federal Trade Commission (FTC) to review certain AI software used as employment assessment tools to investigate for any built in biases and discrimination on race or disabilities.

Aside from potential discrimination and bias with these artificial intelligence assessment tools, consumers are also worried that the employers may be using the AI screening without applicant consent. Not only might consumers be unaware that their interview may contain a third-party AI screening tool tracking their every move, they might also not be allowed the option to opt out of the screening in preference of a traditional method of assessment, nor does it seem like they are able to contest the outcome of the AI screening. This may truly put potential job applicants at a disadvantage during the hiring process. Any potential discrimination or bias with AI assessment tools may also skew equal employment opportunities for many of these candidates.
