THC Products Potentially Mislabeled to Reflect Inaccurate Product Potency Levels

Shub Johns & Holbrook is investigating claims concerning the mislabeling of various THC products. A recent study showed that the THC potency labels of several flower and concentrate products were inaccurate. THC potency mislabeling is concerning—medical users may be unable to accurately monitor their THC intake, and recreational users might not be able able to accurately predict the effects of a mislabeled THC product. Nonetheless, a study conducted by licensed cannabis testing facility MedPharm Research LLC and the University of Colorado Boulder found that, of the THC products they tested, 77 of 178 flower products and 4 of 99 concentrate products were inaccurately labeled. Notably, for a THC product to be deemed inaccurately labeled, it must fall outside a ±15% accuracy threshold. In other words, the study excluded products that contained only minor inaccuracies between labeled product potency and actual product potency.

Several factors, including the rapid growth of the cannabis market, inconsistent regulatory standards, and consumer demand may contribute to the inaccuracies in THC potency labeling. Whatever the source, THC product distributors that allegedly mislabel their product may be putting consumers at a significant risk. These consumers are potentially being deceived by these THC product makers and have a right to know how much THC they are actually consuming.
