On March 19, 2025, Shub Johns & Holbrook LLP, along with its co-counsel, filed a lawsuit in the Dauphin County Court of Common Pleas against the Pennsylvania State Education Association (“PSEA”) related to a recent data breach.
According to the complaint, PSEA acknowledged having experienced a data breach on or around July 6, 2024. The data breach impacted the following type of information: names, birthdates, Driver’s License numbers, Social Security numbers, various financial account numbers, Passport numbers, and health insurance and other medical information.
The complaint alleges that the data breach affected 517,487 individuals, and was reportedly initiated by a ransomware group known as Rhysida.
The complaint alleges that PSEA had a non-delegable duty to safeguard the sensitive personal information that was entrusted to it. The complaint goes on to contend that PSEA breached this duty by failing to reasonably protect this data from the foreseeable event of a data breach. It seeks to represent a class comprised of all persons whose sensitive data was impacted in the data breach. The complaint asserts negligence and other state laws against PSEA.
