Resort Fees may Violate Consumer Protection Laws

Resort guests may be charged for amenity or hotel fees for hotel features that they may not be able to use. Should consumers have to pay for gym access if it is closed on the days they stay at the hotel? Shub Johns & Holbrook LLP launches an investigation into resorts and hotels for charging consumers potentially fraudulent resort, destination, or hotel fees for amenities that they may not be able to use. These amenity fees may be imposed on consumers without guarantee that they would be able to use those resort features, possibly violating consumer protection laws.

Resorts and hotels may impose these fees on all or any of their residents or guests, and may not have sufficient amenities to accommodate all those guests. A resort can impose a pool cleaning fee on all consumers but they may only have 1 pool that may be closed in the morning and evening, making the availability, accessibility and comfort of using the pool unlikely for many consumers – should you have to pay a pool fee or pool cleaning fee if it was too crowded for you to use?

Consumers may feel that some of these destination or amenity fees are unreasonable, yet some hotels and resorts impose them on consumers anyway despite not having the proper resources for all guests to enjoy.
