NCB Management – Final Approval of $2.625 million Settlement

The Pennsylvania federal court presiding over a class action suit against NCB Management Services, Inc (“NCB”) for a data breach impacting consumers’ personal identifiable information recently granted final approval to a $2.625 million class action settlement. Benjamin F. Johns was designated one of the co-lead counsel for the Plaintiffs.

The case is captioned In Re: NCB Management Services, Inc. Data Breach Litigation, No. 2:23-cv-01236-KNS. This case was filed in the United States District Court for the Eastern District of Pennsylvania. The deadline to submit claims pursuant to the settlement has expired. Data Breach at NCB Management

NCB Management learned that it had experienced a cybersecurity attack on February 4, 2023, and conducted an investigation following the cyberattack.

Through its investigation, NCB Management discovered that an unauthorized party had gained access to the company’s information systems. Through further investigation, NCB discovered that over a million individuals’ PII and PHI may have been impacted. Data impacted by the breach includes:

  • Names
  • Addresses
  • phone numbers
  • email addresses
  • birth dates
  • driver’s license numbers
  • Social Security numbers
  • employment positions
  • pay amounts
  • credit card numbers
  • routing numbers account numbers
  • and balance and account statuses

NCB Management Class Action Lawsuit and Final Approval of Settlement

In March 2023, Shub Johns & Holbrook LLP filed a class action lawsuit against NCB Management for the potential impact that the data breach could have or has already had on affected individuals. The Court consolidated all class cases against the NCB data breach on June 5, 2023, and appointed SJH partner Ben Johns as one of the co-lead counsel for the Plaintiffs.

The parties reached an agreement to settle the NCB Management data breach case in May 2025, with the Pennsylvania Court granting preliminary approval of the class action settlement. Impacted individuals were notified in June 2025 about their eligibility to submit a claim pursuant to the settlement.

On September 29, 2025, final approval of the $2.625 million settlement was granted following the Court’s Settlement Fairness hearing held the same day. Honorable Judge Kai N. Scott shared their thoughts and praises on co-lead counsel’s management of the data breach case:
