NCB Management Data Breach Class Action – Preliminary Approval of $2.62 Million Settlement Granted

Plaintiffs in the NCB Management data breach case have reached a settlement in the cybersecurity class action. The Court has approved Plaintiffs’ motion for preliminary approval of the settlement, allowing impacted consumers to fill out a claim through August 26, 2025.

The NCB Management Settlement website is currently unavailable. Consumers will start to receive more information about the settlement in June 2025.

Data Breach at NCB Management

In March 2023, a US-based debt collector, began notifying individuals that their information had been involved in a data breach that exposed individuals’ personally identifying information (“PII”) and private health information (“PHI”).

The debt collector learned that it had experienced a cybersecurity attack on February 4, 2023, and conducted an investigation following the cyberattack. Through its investigation, NCB Management discovered that an unauthorized party had gained access to the company’s information systems. Through further investigation, NCB discovered that approximately 1 million individuals’ PII and PHI was impacted. Data impacted by the breach includes:

Names
Addresses
phone numbers
email addresses
birth dates
driver’s license numbers
Social Security numbers
employment positions
pay amounts
credit card numbers
routing numbers
account numbers
and balance and account statuses

Preliminary Approval of the NCB Management Settlement

In or around late March 2023, Shub Johns & Holbrook LLP filed a class action lawsuit against NCB Management for the potential impact that the data breach could have or has already had on affected individuals. The Court consolidated all class cases against the NCB data breach on June 5, 2023.

On May 13, 2025, following a motion for settlement filed by Plaintiffs, the US District Court for the Eastern District of Pennsylvania granted preliminary approval of a $2.625 million settlement for the affected class.. Pursuant to the Court’s Order, Benjamin F. Johns of Shub Johns & Holbrook LLP is designated as one of the co-lead counsel for the settlement class. Individuals impacted by the breach will be notified and will have the chance to submit a claim through the claims deadline on August 26, 2025 for participation in the class action settlement. The Court has scheduled a final approval hearing for September 29, 2025. Additional details regarding the Proposed Settlement are still to come.
