Listerine Class Action Suit Alleges Misleading Marketing of Cool Mint Mouthwash

Listerine is advertised as having the ability to kill 99% of germs that can lead to plaque, gingivitis or other common oral ailments. The Listerine Cool Mint antiseptic mouthwash is marketed as a bactericidal product used to prevent oral health problems and eliminate potentially harmful bacteria. However, a recent study indicates that the regular use of the product may actually lead to the growth of potentially cancerous bacteria.

 A recent study published by the Journal of Medical Microbiology indicated that after three months of testing, the use of Listerine Cool Mint mouthwash increased the abundance of “oral opportunistic bacteria” leading to concerns about the prolonged use of Listerine mouthwash. The study concluded that the “regular use of Listerine mouthwash should be carefully considered.”

Shub & Johns LLC filed a class action lawsuit on September 3, 2024 against Johnson & Johnson, the former manufacturer of Listerine, as well as Listerine’s current manufacturer Kenvue Inc., a healthcare company previously a part of Johnson & Johnson’s Consumer Healthcare division. The proposed class action lawsuit alleges that Listerine Cool Mint mouthwash is deceptively marketed by these manufacturers and misleads consumers because it fails to warn of the potential proliferation of harmful bacteria through regular use of the product.

The case is Vasseur v. Johnson & Johnson Consumer, Inc. et al., No. 2:24-cv-7487, and is pending in the United States District Court for the Central District of California.
