East River Medical Imaging Data Breach – Final Approval of $1.85 million Settlement

The New York court presiding over a class action suit against East River Medical Imaging for a data breach impacting consumers’ personal identifiable and private health information nationwide recently approved Plaintiffs’ Motion for Final Approval of its $1.85 million class action settlement. The case is captioned Guarnaschelli et al. v. East River Medical Imaging, P.C., No. 656099/2023 (Sup. Ct. NY.). This case was filed in the Supreme Court of New York. Data Breach at East River Medical Imaging

In late November 2023, the New York based healthcare imaging provider East River Medical Imaging (“East River” or “ERMI”), began notifying individuals that their information was involved in a data breach that exposed individuals’ personally identifying information (“PII”) and private health information (“PHI”).

The company learned that it had experienced a cybersecurity attack between August 31, 2023 and September 20, 2023, and conducted an investigation following the cyberattack. Through its investigation, ERMI discovered that an unauthorized party had gained access to the company’s information systems. Through further investigation, ERMI discovered that approximately 606,000 individuals’ PII and PHI was impacted.

Information including names, contact information, insurance information, exam and/or procedure information, referring physician, and/or imaging results, and Social Security numbers may have been acquired by the unauthorized third party.

Final Approval of the East River Medical Imaging

On December 5, 2023, Shub Johns & Holbrook LLP filed a class action lawsuit against East River for the potential impact that the data breach could have or has already had on affected individuals. On March 26, 2024, Plaintiffs in the case filed a consolidated amended complaint after the judge ordered that all matters against East River be consolidated.

Following a hearing held in June 2024 on Plaintiffs’ Motion for preliminary approval of a class action settlement, for which SJ&H LLP Partner Samantha Holbrook attended on behalf of the Plaintiffs, the New York Supreme Court granted preliminary approval of the class action settlement. Impacted individuals were notified in July 2024 about their eligibility to submit a claim pursuant to the settlement.

On May 13, 2025, the Court granted final approval of the $1.85 million settlement. The deadline to submit claims pursuant to the settlement has expired. Class members who have submitted claims may be able to anticipate payments later this year.
