On March 31, 2025, the United States District Court for the Southern District of Ohio issued an Opinion and Order that denied, in large part, a motion to dismiss that had been filed by the Defendant, Proctor & Gamble Company (“P&G”) in a consumer class action filed by clients represented by Shub Johns & Holbrook LLP.
The Plaintiffs in the lawsuit are eight consumers from across the country who purchased Febreze clips manufactured by P&G. Febreze clips are car air fresheners that are attached to interior air conditioning vents. According to the complaint, the Febreze clips suffer from a defect that causes them to leak, which results in damage to interior vehicle components such as consoles, entertainment systems, buttons, carpets, dashboards and vents. Each of the Plaintiffs experienced significant damage to their vehicles as a result of this alleged defect.
P&G responded to Plaintiffs’ lawsuit by filing a motion to dismiss and to strike the class action allegations from the complaint. The Court’s recent opinion largely denied P&G’s motion to strike. It also rejected P&G’s attempt to dismiss the Plaintiffs’ claims (in large part) for negligence, breach of implied warranty and unjust enrichment, and under the consumer protection statutes of various state laws.
