Court grants Final Approval to $650K Settlement in Fitzgibbon Hospital Data Breach Case

Fitzgibbon Hospital Data Breach

Fitzgibbon Memorial Hospital, Inc., or Fitzgibbon Hospital, experienced a cybersecurity incident that compromised its network on or around June 2022. Fitzgibbon is a Missouri-based healthcare provider withs its facility Marshall, MO.

The incident impacted sensitive information including patient names, dates of birth, medical record numbers, patient account numbers, Social Security numbers, and medical and treatment information. The data breach exposed approximately 112,072 individuals.

Shub & Johns filed a class action lawsuit against Fitzgibbon on January 10, 2023 in the Circuit Court of Saline County at Marshall, Missouri, and proceeded to file a Consolidated Amended Complaint on April 27, 2023 after the Missouri Court granted Plaintiffs’ motion to consolidate all actions against Fitzgibbon.

Final Approval of the Fitzgibbon Settlement

On May 29, 2024, The Missouri Court granted Plaintiffs’ motion for preliminary approval of a $650K class action settlement in the consolidated Fitzgibbon data breach litigation following Plaintiffs’ motion for settlement. The Court also appointed Shub & Johns attorney Benjamin F. Johns as Settlement Co-Class Counsel. Impacted Consumers were notified and given the opportunity to submit a claim through September 26, 2024.

On September 20, 2024, following the Court’s hearing on final approval of the class action settlement, Circuit Judge Dennis A. Rolf of Saline County issued an order granting final approval to the $650K settlement. Class members who submitted a valid claim for compensation can expect to receive their portion of the settlement fund in the months following the Court’s order.
