Judge Largely Denies Defendants’ Motion to Dismiss Allegheny Health Network Data Breach Class Action

A Pittsburgh-based Judge recently issued an favorable order largely denying a motion to dismiss the data breach class action case against Allegheny Health Network. Defendants Allegheny Health Network (“AHN”) and IntraSystems LLC, AHN’s IT vendor, are expected to issue a response to Plaintiffs’ class action complaint. While this is a positive result for the proposed class, Plaintiffs continue their efforts to resolve the case for putative class members.

InstraSystems’ Cybersecurity Incident impacts AHN files

In 2024, Allegheny Health Network, a Pittsburgh-based health organization, suffered a data breach that affected 294,000 patients through its IT vendor, IntraSystems. The stolen information consisted of patients’ names, dates of birth, addresses, SSNs,financial account numbers, and health insurance identification numbers.

Shub Johns & Holbrook, along with co-counsel, filed a proposed data breach class action complaint in January 2025. Following the Court’s consolidation of all related cases and Plaintiffs’ amended complaint, AHN and InstraSystems filed a motion to dismiss Plaintiffs case.

Court Order on Allegheny Health Network’s Motion to Dismiss

On August 5, 2026, the Pennsylvania Western District Court issued a memorandum order granting in part and denying in part AHN and IntraSystems motion to dismiss the data breach class action case. They argued that Plaintiffs lack Article III standing because they had not suffered a legally sufficient injury. After careful

review, the Court finds that Plaintiffs have standing. The court allowed several claims to survive. Namely, the presiding Judge agrees that Plaintiffs have Article III standing and similarly have sufficiently pled as to injury and negligence on Defendants’ part.

While the court did dismiss Count IV of the class action complaint for both Defendants and Count V against Defendant InstraSystems, many claims survive giving Plaintiffs room to aggressively seek restitution for the proposed class.
