A federal court for the middle district of Tennessee recently appointed Shub Johns & Holbrook Managing Partner Benjamin F. Johns as interim co-lead class counsel in a class action lawsuit against Nissan following reports that models of the Nissan Rogue are experiencing an alleged defect that causes the rear window to shatter.
The case and other similar cases were consolidated by the court, now requiring Plaintiffs to file an amended class action complaint. The case is Delucia-Roitman et al v. Nissan North America, Inc. et al, 3:26-cv-00014 (M.D. Tenn).

Owners of the 2021 – 2025 Nissan Rogue had previously reported concerns regarding their vehicles’ rear windows. Consumers indicate that the rear window shatters without warning or identifiable reason, leaving consumers with a mess and potentially out of pocket expenses.
Consumers expressed hearing loud pops before discovering the shattered glass spread across the floor and their vehicle. Some indicate that this may happen parked, other share that the windshield bursts while driving
Repairs and replacements of the rear windshield can be expensive, with many consumers potentially paying out of pocket for this fix. Aside from that, this can pose serious safety concerns. The vehicle’s shattered glass can lead to injury or increased risk of theft.
On January 6, 2026, Shub Johns & Holbrook filed a class action case against Nissan for the potential defect with the rear window, alleging Nissan knew or should have known about the rear window defect but failed to disclose the concern to potential buyers, putting consumers at an increased safety risk and risk of financial burden.
On April 1, 2026, the Tennessee federal court granted a motion for Plaintiffs’ counsel to consolidate all cases filed against Nissan for the alleged rear window defect. In its order, the Court appointed SJ&H’s own Benjamin F. Johns as interim co-class counsel. Plaintiffs are tasked with filing a consolidated amended complaint in mid-May 2026.
The class action currently alleges that 2021 – 2025 models of the Nissan Rogue may experience this defect. The case is captioned Delucia-Roitman et al v. Nissan North America, Inc. et al, Case No. 3:2026-cv-00014 (M.D. Tenn).
