Consumers clicking through their email may come across a deceptive method of advertising products and services through emails. Attention-grabbing terms like “Last Chance” or “Today Only” take over the subject line and may make consumers interested or anxious about a deal they could miss out on.
But the class action attorneys at Shub Johns & Holbrook want consumers to know that this may be a deceptive and misleading business tactic used by retailers and other companies may violate some consumer protection laws in California, Washington & Maryland.
These email subject lines may create a false sense of urgency or potentially misrepresents discounts or promotions especially when a time frame is provided. In some instances, the sale would or could continue past the previously stated “today only” time frame. Key commercial communication laws, such as Washington’s Commercial Electronic Mail Act (CEMA) seek to prohibit false or misleading information included in email subject lines, encouraging transparency with the first few words communicated to the reader.
Have you received any misleading emails, providing inaccurate or false information in the subject line? Let us know! Fill out the form to join our investigation!
