Shub Johns & Holbrook LLP (SJH) has opened an antitrust investigation into whether companies or industries in the United States are engaging in anticompetitive business practices that may harm consumers and restrict fair competition. This follows a recent European Commission probe into the ski equipment industry, which raised concerns about potential price fixing and market manipulation ahead of the winter season.
In the European Union, investigators suspect that certain ski equipment manufacturers may have violated EU competition laws by forming cartels or engaging in restrictive agreements prohibited under Article 101 of the Treaty on the Functioning of the European Union (TFEU). These practices – such as price coordination or limiting supply – can inflate consumer costs and reduce market choices.
SJH is now investigating whether American companies in similar sectors may be engaging in comparable anticompetitive conduct. Under U.S. law, including the Sherman Antitrust Act, businesses are prohibited from monopolizing markets or entering agreements that unlawfully restrain trade.
