Shub Law continues to investigate claims that lidocaine pain relief products marketed as being “Max Strength” may not be as strong as their manufacturers represent. On March 19, 2021, Shub Law filed two lawsuits on behalf of consumers who purchased IcyHot® and Salonpas® brand lidocaine back patches for pain relief. These packages, and others, are marketed as being “Max Strength.” In truth, consumers may not be getting as much strength as they can.
Lidocaine is a local anesthetic that prevents pain by blocking the signal of nerve endings. (1). This makes it especially useful in products designed for pain relief and relief from body soreness. It is also a non-narcotic pain reliever. Products utilizing lidocaine have seen a surge in popularity over the last few years. (2). Often, products on drugstore shelves indicate that they are a “Max Strength” lidocaine product to insinuate they have the maximum strength of lidocaine in their product possible to entice consumers.
Many products state they are “Max Strength”, including the IcyHot® and Salonpas® Back Patches at issue in the March-filed complaints. However, for many over-the-counter lidocaine pain relief products, this simply isn’t the case. The IcyHot® and Salonpas® products – among others – contain just 4% lidocaine as their supposed “max strength.” A comparable prescription product typically contains 5% lidocaine. For chronic pain sufferers, that 1% could be the difference that gives them relief. However, over-the-counter lidocaine pain relief product customers often are not getting the “Max Strength” they are paying for.
