Shub & Johns attorney filed a class action lawsuit against Fitzgibbon Hospital on January 10, 2023 in the Circuit Court of Saline County at Marshall Missouri.  On April 27, 2023, Shub & Johns, along with co-counsel, filed a Consolidated Amended Complaint after the Missouri Court granted the Plaintiff’s motion to consolidate all actions against Fitzgibbon concerning the data breach.

Preliminary Approval of the Fitzgibbon Hospital Settlement

On November 22, 2023, Shub & Johns filed an unopposed motion for preliminary approval of a class action settlement On March 26 2024, the Court held a hearing reviewing the case and to review Plaintiff’s Preliminary Approval Order of a Settlement. The court held a hearing on preliminary approval of the settlement on May 29, 2024, and subsequently granted Plaintiffs’ motion for a class action settlement. Individuals impacted will have the chance to submit a claim before the final approval hearing, which is set for September 10, 2024. Details regarding the Proposed Settlement are still to come.
