Shub Law Seeks Justice For Quickly Corroding Mercedes Vehicles

A recent lawsuit on behalf of many Mercedes-Benz owners brought by the Shub Law Firm seeks remedy for model vehicles whose rear subframes develop rust or corrosion.

The Shub Law Firm takes on another giant of the industry! Consumer Attorney, Jonathan Shub, filed a class action lawsuit against Mercedes-Benz USA, LLC on March 17, 2023, in the United Stated District Court for the Northern District of Georgia. The lawsuit alleges that Mercedes knowingly and deceptively marketed, manufactured and sold Mercedes model vehicles that quickly corrode or develop rust on the vehicle’s rear subframe or surrounding areas.

Mercedes Class Models at Risk of Developing Rust

The Shub Law Firm, and co-counsel, filed a class action complaint on March 17, 2023, representing their client, Mr. Averbach, and his vehicle suffered damages from the allegedly negligent production of various Class Vehicles. Including Mr. Averbach’s 2010 Mercedes-Benz GLK 350.

While the Plaintiff initially purchased the vehicle for his and his own family’s leisure and primary mode of transportation, Mr. Averbach and his family have become wary of driving the vehicle after nearly suffering what could have been a fatal accident.

Upon inspection, the vehicle was discovered to have corrosion and rust eating away at the vehicle’s rear subframe, an issue that was not flagged by the authorized Mercedes Inspector before Mr. Averbach finalized his purchase of the vehicle.

Shub Law Firm Takes Action for Rear Sub Frame Issue

The lawsuit filed on Mr. Averbach’s behalf argues that this is an issue that may be affecting other similarly situated owners and Class Vehicles. While many individuals seem to have been affected by the matter — in some instances paying exorbitant fees to repair the corrosion — Mercedes-Benz USA may be breaching consumer warranties. If this issue is affecting an entire class of vehicle owners, then this problem may have to do with the mass manufacturing and distribution of such vehicles.
