Samantha Holbrook appointed to the Executive Committee Counsel in Murfreesboro Medical Clinic Data Breach Litigation
A Tennessee court recently appointed Shub & Johns LLC Partner, Samantha E. Holbrook, to the Interim Executive Counsel Committee in a consolidated class action lawsuit against Murfreesboro Medical Clinic P.A. doing business as Murfreesboro Medical Clinic & Surgicenter (“MMC”) after a data breach exposed patients’ and employees’ personal identification and health information from within MMC’s servers.

Data Breach at the Murfreesboro Medical Clinic
On May 2, 2023, Murfreesboro Medical Clinic & Surgicenter, the Tennessee-based medical service provider and health system posted a notice on its website indicating that patients’ information was involved in a data breach that exposed personal identification information and health information.
The company learned of the security breach in April of 2023 and immediately conducted an investigation. MMC determined that on April 22, 2023 a cybersecurity incident resulted in client files being copied from its network. Through further investigation, MMC discovered that approximately 559,000 individuals’ information was affected.
Information including patients’ and employees’ names, Social Security numbers, insurance information, treatment information, prescription information, dates of birth, email addresses, phone numbers, driver’s license numbers, and potentially more.
MMC Lawsuit
On July 9, 2023, Shub & Johns LLC filed a class action lawsuit against the Murfreesboro Medical Clinic for the potential impact that the data breach could have or has already had on affected individuals.
On September 6, 2023, the 16th Judicial Circuit Court for Rutherford County, Tennessee ordered that putative class action cases against MMC were to be consolidated. On September 26, 2023, the court also appointed Samantha E. Holbrook, a seasoned litigator at Shub & Johns LLC, as a part of the Interim Executive Committee Counsel in the data breach Litigation.
