Court Grants Motion for $1.85M Settlement in East River Medical Data Breach Case

East River Medical Imaging Data Breach

hacker sitting at desk in low light.East River Medical Imaging (“East River” or “ERMI”), a New York-based healthcare imaging provider, experienced a cyber security incident between August 31, 2023 and September 20, 2023. The incident potentially impacted sensitive information including consumers’ names, contact information, insurance information, exam and/or procedure information, referring physician, and/or imaging results, and Social Security numbers. The Plaintiffs in the lawsuit allege that the data breach put them at risk of fraud or suspicious activity.

Shub & Johns attorneys filed the first putative class action lawsuit against East River on December 5, 2023 in the Supreme Court of New York for New York County.  On February 5, 2024, the Court issued an order appointing S&J partner Benjamin F. Johns one of two Interim Co-Lead Plaintiffs’ Counsel. A single consolidated complaint was filed on March 26, 2024.

Preliminary Approval of the East River Settlement

On April 16, 2024, Shub & Johns, along with its co-counsel, filed an unopposed motion for preliminary approval of a class action settlement.

UPDATE (June 28, 2024): On June 24, 2024, Shub & Johns attorneys Samantha E. Holbrook and Benjamin F. Johns attended a hearing in New York Superior Court after filing an unopposed motion for preliminary approval of a class action settlement in April. Individuals impacted by the breach will be notified and have the chance to submit a claim before the final approval hearing set on October 22, 2024.
