The automotive giant, Subaru, faces a class action lawsuit, where six drivers claim that the Forester, Legacy, and Outback models accelerate without the driver pushing the gas.  

On May, 13, 2020, a class action lawsuit was filed in a New Jersey federal court against Subaru of America, INC. In the lawsuit the 2012-2018 Subaru Forester, 2015-2019 Subaru Legacy, and 2015-2019 Subaru Outback vehicles were highlighted as containing defects that put the drivers at risk.  

DANGEROUS DEFECTS IN SUBARU VEHICLES 

The suit explains that the vehicle models alleged contain a “Sudden Acceleration Defect,” in which the car will accelerate without warning, and often when the driver is pushing on the brake pedal. This is due to “three primary respects,” the suit claims, such as an “inadequate fault detection system…faulty circuit boards…[and] brake override system malfunctions.” The suit claims that Subaru has known of these defects since 2011, but continues to sell the models without fixing the defects.  

With these defects, near-collisions and accidents have occurred, including two people being hospitalized. 

SUBARU AVOIDING RESPONSIBILITY 

When people go to get the defect fixed, it is alleged that Subaru instructs the dealers to state that the cars are “operating normally” or that “no issues could be found.” Subaru is preying upon the average consumer for not having enough automotive technical knowledge as the company passes blame around. When drivers seek to fix the defect, they are also met with the blame being thrown on them, with Subaru dealers pointing out floormats as the cause of the issue. Even worse, some Subaru models have had a defective component replaced with another faulty part, according to the suit. Doing this puts not just the driver at risk, but also affects the resale value of the car.
