Jonathan Shub appointed as Class Counsel in Class Action Case against United Health Care
Jonathan Shub, Partner at Shub & Johns LLC, was recently appointed as co-class counsel in a class action suit against United Health Care Services (“United”) alleging that United violated the Telephone Consumer Protection Act (TCPA) after individuals began receiving unwanted automated calls from Untied and continuing to receive unwanted calls even after requesting to be removed from the calling list.
A Seattle Court appointed Jonathan Shub after certifying two different classes of individuals affected by United Heath Care’s alleged violations. The case is Samson v. UnitedHeathCare Services Inc., No. 2:19-cv-0175 filed in the United States District Court for the Western District of Washington.
Though the case was filed in 2019, the case entered a stay period pending the outcome of three similar cases filed in the Eastern District of California. Following the lift of this stay period, Plaintiff in the case filed a second motion for class certification for two classes. These two classes include:
- The Wrong Number Class: Individuals who allegedly received non-emergency automated calls from United Health Care but were not members of United.
- The Do-Not-Call Class: Individuals who allegedly received non-emergency automated calls from United Health Care but indicated that they wish to be removed from the automated call list.
On October 13, 2023, the Court concluded that Plaintiff provided sufficient evidence to certify these two classes. Jonathan Shub, along with appointed Class Counsel, will propose a plan to the court on how the class should receive notice.
