On September 7, 2023, Shub & Johns filed a class action complaint in the Central District of California against F21 OpCo LLC (doing business as Forever 21) related to a recent data breach that included the personal identification information of 539,207 individuals across the United States. Forever 21, based in Los Angeles, California, is a widely known retail store company with stores all over the US.
According to the complaint, Forever 21 identified a cyber security incident around March 20, 2023 that impacted a limited number of systems between January 5 and March 21, 2023. Information affected by the data breach includes personal information for many employees and individuals including, names, social security numbers, dates of birth, bank account numbers, and information regarding Forever 21 employees’ health benefit plans.
The complaint filed by S&J alleges that Forever 21 had a non-delegable duty to ensure that the company would take reasonable measures to safeguard employees’ and consumers’ sensitive information. The complaint alleges that Forever 21 failed to do so, and asserts claims on behalf of a putative class for negligence, negligence per se, breach of fiduciary duty, breach of implied contract, unjust enrichment, and violations of California consumer protection laws.
