Shub Law is investigating claims for a class-action lawsuit against Microsoft for its praised Xbox One controllers for an alleged drifting defect. It has been alleged that Microsoft has known about the drifting defect in its controllers for years, but has yet to fix the issue or offer proper compensation to purchasers.
THE DRIFTING DEFECT IN XBOX ONE CONTROLLERS
Having a good, sturdy controller is so important when gaming. Consumers shouldn’t have to deal with their controllers breaking without understandable reasons. The alleged drifting defect occurs in Xbox One controllers, and Xbox Elite Series 1 and 2. Consumers complain that a short time after purchasing the Xbox Elite controller, they noticed the drifting defect.
Drifting occurs when movements are being registered in-game even when the analog sticks are untouched. Clearly, this can become a huge issue for gamers. It has been alleged that there is a design flaw with the potentiometer in the joystick component, where resistive material is scraped off a curved track and causes unwanted electrical contact. It has further been alleged that consumers have been complaining about this defect since 2014. It has become such a large issue that googling the defect will result in forms and videos of consumers trying to fix the issue on their own.
MICROSOFT’S DECEPTIVE MARKETING OF XBOX CONTROLLERS
Playing video games and using console devices is not a cheap hobby. Consumers want to trust that their money is being well spent. Microsoft advertises that their general Xbox controllers (priced around $59.99) are superior and will enhance gaming and that their Elite series controllers ($179.99) are “the world’s most advanced controller” and offers “ultimate precision.” Unfortunately, this alleged drifting defect suggests otherwise.
It has been alleged that “Microsoft does not disclose to consumers that the Xbox controllers are defective, causing the joystick component to fail.” By deceptively marketing their products, consumers suffer. It’s one thing for Microsoft to know of this defect, but to not disclose it and refusing to repair the controllers without charge is worse.
