Court Grants Preliminary Approval to $2.9 Million Data Breach Settlement with Wright & Filippis
Wright & Filippis LLC, a Michigan-based prosthetics and orthotics provider, experienced a cyber security incident that compromised Wright & Filippis’s network between January 26 through January 28, 2022. Through its investigation, Wright & Filippis discovered on May 2, 2022 that patients’ protected health information (PHI) along with personal identification information (PII) was likely impacted. The incident potentially impacted sensitive information including names, Social Security number, and patient number and/or health information for current and former patients. The breach also seemed to impact information such as name, date of birth, social security number, and driver’s license number or state ID for current and former employees and job applicants. The data breach affected approximately 877,584 individuals, potentially putting them at risk of fraud or suspicious activity.
Shub & Johns filed a class action lawsuit against Wright & Filippis on December 1, 2022 in the United States Court for the Eastern District of Michigan. On February 24, 2023, Shub & Johns, along with co-counsel, filed a Consolidated Amended Complaint.
Preliminary Approval of the Wright & Filippis Settlement
On October 12, 2023 Plaintiffs’ Counsel filed a motion for Preliminary Approval of a $2.9 Million Settlement in the Wright & Filippis Data Security litigation. On January 4, 2024, the Michigan Court granted Plaintiffs’ Motion for Preliminary Approval, appointing Shub & Johns LLC as Settlement Co-Class Counsel. A Final Fairness Hearing is set for May 30, 2024. Individuals impacted will have the chance to submit a claim before the final fairness hearing.
