Class Members Eligible to file Claims in $2.35 million Data Breach Settlement with Dickey’s Barbecue Pit

The United States District Court for the Northern District Court of Texas recently granted preliminary approval of a settlement agreement in Kostka, et al. v. Dickey’s Barbecue Restaurants Inc. The settlement provides for the payment of $2.35 million to resolve a class action lawsuit related to a data security incident Dickey’s announced in October 2020. Specifically, between April 23, 2019, and October 29, 2020, unauthorized actors accessed Dickey’s point-of-sale systems and obtained customers’ cardholder information, including credit and debit card numbers, card expiration dates, and cardholder names on payment cards that were used at Dickey’s locations during that time period.

The Settlement is on behalf of all residents of the United States who used a payment card to make a purchase at an affected Dickey’s Barbecue Pit restaurant between April 23, 2019, and October 29, 2020.  To view the full list of affected Dickey’s locations, please refer to Exhibit B of the Settlement Agreement.

If you used a credit or debit card to make a purchase at one of these affected Dickey’s locations at any time between April 23, 2019 and October 29, 2020, then you can make a claim for settlement relief. You may receive monetary reimbursement, a lump-sum cash payment, or credit monitoring services if you fill out the Claim Form, if the Settlement is approved, and if you are found to be eligible for a benefit. Additionally, Dickey’s has implemented and agreed to further implement significant data security enhancements. Claim Forms must be submitted online or postmarked no later than April 22, 2023.
