Shub Law Firm is investigating claims against many companies for selling illegal hangover remedies. Recently, the U.S. Food and Drug Administration (“FDA”) announced it has issued warning letters to seven companies for illegally selling unapproved products labeled as dietary supplements that claim to cure, treat, mitigate or prevent hangovers, in violation of the Federal Food, Drug, and Cosmetic Act (FD&C Act).
Warning Letters Issued By FDA
The following companies were issued warning letters:

- Ebnsol Inc.
- Vita Heaven LLC (doing business as Hangover Heaven)
- Happy Hour Vitamins
- LES Labs
- Mind, Body & Coal LLC
- Purple Biosciences LLC
Under the FD&C Act, products intended to cure, treat, mitigate or prevent disease are drugs and are subject to the requirements that apply to drugs. Unlike drugs approved by the FDA, there has been no FDA evaluation of whether these unapproved products are effective for their intended use, what the proper dosage might be, how they could interact with FDA-approved drugs, or whether they have dangerous side effects or other safety concerns.
Consumers should be wary of companies that market hangover remedies as cures or elixirs that can treat or prevent hangovers. The FDA advises consumers to talk to their doctor, pharmacist, or other health care professional before deciding to purchase or use any dietary supplement or drug. These supplements could interact with other drugs you are taking. Not only are these hangover remedies snake oil, but they could also be dangerous.
The FDA has requested responses from the companies listed above stating how they will correct the violations.
