District Court Preliminarily Approves $1.25 Million Data Breach Settlement in In re Onix

Onix Group LLC Data Breach

The Onix Group LLC, a Pennsylvania-based real estate company that provides management and consulting services to a variety of businesses, experienced a cyber security incident that compromised Onix’s network between March 20 and March 27, 2023. The incident potentially impacted sensitive information including consumers’ names, Social Security numbers, and dates of birth, as well as scheduling, billing, and clinical information. The data breach affected approximately 308,942 individuals, potentially putting them at risk of fraud or suspicious activity and misuse of their Private Information. Though the company experienced the breach in March of 2023, it did not inform impacted consumers until May 30, 2023.

Shub & Johns attorney filed a class action lawsuit against Onix on June 15, 2023 in the United States District Court for the Eastern District of Pennsylvania.  On September 15, 2023, Shub & Johns, along with co-counsel the Milberg Law Firm, filed a Consolidated Amended Complaint after the Pennsylvania Court granted the Plaintiff’s motion to consolidate all actions against Onix concerning the data breach.

Preliminary Approval of the Onix Group Settlement

Following the consolidated amended complaint, Benjamin Johns, and other Plaintiffs’ attorneys, engaged in arm’s length negotiations with counsel for the Onix Group, reaching a tentative resolution to settle this matter on a class wide basis.

On June 14, 2024, Shub & Johns filed an unopposed motion for preliminary approval of a class action settlement. On the same day, the Pennsylvania District Court granted plaintiffs’ motion for preliminary approval of a class action settlement, and issued a memorandum appointed Benjamin F. Johns, along with co-counsel at Milberg, Co-Class Counsel for the settlement.

Individuals impacted will have the chance to submit a claim before the final approval hearing, which is set to be in front of Honorable Judge Karen S. Marston on November 20, 2024.
